18.20.010 Authority and Enforcement.

A. The Director, Sheriff, or authorized agent shall have the authority to revoke any permit relating to using, entering, or operating at any County Park or facility upon a finding of a violation of any regulation in this chapter or upon a finding of a violation of any other County Code provision, regulation or local, state, or federal law.

B. The Director, Sheriff or authorized agent shall have the authority to eject from any County Park or facility any person acting in violation of any regulation in this chapter or upon a finding of a violation of any other County code provision, regulation or local federal or state law.

C. The Director, Sheriff or authorized agent shall have the authority to ban any person from entering or using any County Park or facility for any length of time when such person has reasonable grounds to believe that the person has violated any provision of this chapter or any applicable local, state or federal law, rule or regulation.

D. The Director, Sheriff or authorized agent is authorized to suspend and/or revoke any county park or facility permit if issued unlawfully or erroneously.

E. It is unlawful for any person to enter or re-enter any County Park or facility when the permission for such entry has been suspended, revoked, or when such person has been expelled from the County Park or facility. Any person aggrieved by such suspension, revocation or expulsion may appeal to the Director of Parks and Recreation within ten days of suspension, revocation or expulsion. The determination by the Director of Parks and Recreation may be appealed to the Chief Executive Officer with ten days of the decision of the Director of Parks and Recreation. The determination of the Chief Executive Officer shall be final.

 

18.20.020 Boating Laws Compliance.

All boats in any recreation area must comply with the provisions of the Harbors and Navigation Code, the regulations of the California Department of Boating and Waterways, and any other regulations, enacted to implement these laws. Violation of this section shall be punishable as provided for such violation by state law. (Ord. CS 512 §5, 1993; prior code §10-2(b)).

 

18.20.030 Vehicle Code Compliance.

All vehicles in any recreation area must comply with the provisions of the Vehicle Code. Violation of this section shall be punishable as provided for such violation by the Vehicle Code. (Ord. CS 512 §4, 1993; prior code §10-2(a)).

 

 

18.20.040 Infractions Designated.

A. Unless otherwise noted, it is unlawful and constitutes an infraction for any person to violate or fail to comply with any ordinance in any recreation area.

B. Unless designated a misdemeanor, failing to comply with rules or regulations adopted by the Board of Supervisors providing time-of-day restrictions, use fees, special use areas, and health, safety and welfare regulations.

 

18.20.050 Misdemeanors Designated.

It is unlawful and constitutes a misdemeanor for any person to violate or fail to comply with any of the following provisions:

A. The Director, uniformed peace officers, and other authorized agents may order the closure of all or part of a recreation area at any time. It is unlawful for any person to remain or enter the area for any reason after such an order has been given. The Director or authorized agent who issues the order shall, on the next regular county workday, submit to the Chief Executive Officer and the Clerk of the Board of Supervisors a detailed report of the reason(s) for the order. B. As a further measure to protect the health, safety and welfare of person using a recreation area, any person violating a provision of this title, or, while in a recreation area, any provision of state law, may be ordered, by an officer or employee authorized to enforce the provisions of this title, to leave all or part of a recreation area and not to re-enter such area for any period up to twelve months. Any person ordered to leave a recreation area pursuant to this section shall not be entitled to a refund of any park user fees. Failure to obey such order shall be a misdemeanor. (Ord. C. No dog over four months of age shall be in any recreation area without a current license issued by an entity of the state or local government unless the owner or possessor has in their possession proof of current rabies vaccination.

D. It is unlawful to use or enter any recreation area or facility without first having paid the fee as defined in the current adopted fee schedule and having received the required receipt or permit.

E. A receipt for fee shall not altered, defaced, or used in any way for the purpose of avoiding the payment of any required fee. A receipt for fees shall not be used by any person other than the original purchaser for the purpose of avoiding the payment of any required fee and are to be presented upon request. (ord. F. Possessing, discharging, setting off, or causing to be discharged in or into any portion of any recreation area any firecrackers, torpedoes, rockets, fireworks, oil, explosives, or other substances which may be harmful to the health or safety of persons.

G. Failing to obey any lawful order of a peace officer or authorized county employee.

H. Operation of any and all watercraft in the area between the buoys and the water quality wall at the reservoirs is punishable by a five hundred dollar fine. (Ord. CS 1120 §1, 2012; Ord. CS      512 §3, 1993; Ord. CS 262 §2, 1987; Ord. CS 20 §§20, 21, 1983; prior code §10-2(d)).

I. No person shall, without express permission of the owner, discharge a firearm within one hundred fifty yards of any dwelling, barn, or outbuilding, or within such a distance of any building as to create a hazard or to endanger the lives or property of the occupants, owners, or persons in or near the building(s).

J. No person shall discharge a firearm, bow and arrow, slingshot or any missile launching device in or into a recreation area, except as provided under subsection K of this section.

K. Shooting of waterfowl shall only be done from authorized waterfowl blinds. (Ord. CS 512 § 11, 1993; Ord. CS 20 § 18, 1983; prior code § 10-38).

L. It shall be unlawful to enter or leave an area or crossing its boundaries at any point other than a designated entrance or to trespass in any area, building or facility which is fenced and locked or enclosed and locked or is posted with a “No Trespassing” sign.

M. It is unlawful to cut, break or deface in any way building, equipment, grounds, or other facilities of any park. It shall be unlawful for any person without authority to tear down, deface or destroy any sign posted.
